General Rental Conditions

The equipment rental service is provided by Zimzala Surf Culture, owned by Watersmile, Lda (hereinafter referred to as the “lessor”). These rental conditions are an integral part of the rental contract. By accepting the general terms and conditions, the hirer confirms that they have read and fully accepted these conditions.

1. Equipment Pick-Up

The hirer receives the equipment in good working condition. Any complaints must be made to the lessor at the time of pick-up.

2. Equipment Return

The hirer agrees to return the equipment at the end of the rental period defined in the agreement and during business hours. All equipment and accessories provided (e.g., wetsuits, leashes, etc.) must be returned in perfect condition. Lost or damaged accessories will be charged according to the current price list.

3. Responsibility

The hirer is responsible for the rented equipment and for any damage caused to it or to third parties. In the event of loss, damage or theft, the hirer will be charged according to the replacement value of the item, as published by the lessor.

Important: Always store the equipment safely and never leave it unattended in public spaces. Proper care is essential to avoid damage.

4. Rental Period Extension

An extension is only possible with prior consent from the lessor before the current rental agreement expires. The lessor reserves the right to refuse the extension without justification.

5. Minimum Age of Hirer

The minimum age to rent equipment is 14 years old.

6. Services and Prices

The prices published by the lessor, either in brochures or online, are applicable.

7. Insurance

The hirer is responsible for securing adequate insurance for risks associated with the use of the equipment. The equipment is not insured against theft or damage.

Watersmile, Lda holds an Allianz insurance policy nº 205421831 which only covers personal accidents during the rental period, up to €3,500 for medical treatment.

Note: In case of an accident involving third parties, the insurance does not cover third-party equipment or injuries. The hirer is fully responsible for any claims and agreements with third parties.

8. Safety Equipment

Any safety equipment provided (e.g., helmet, buoyancy aid) must be used at all times. Insurance coverage will not apply if safety equipment is not used.

9. Hirer’s Responsibility

The hirer agrees to use the rented equipment carefully, without endangering others, and in accordance with the provided safety instructions.

The hirer is fully responsible for any physical or material damage caused during the use of the equipment (art. 1023 of the Civil Code). Zimzala Surf Culture is not liable for any accidents or damage suffered or caused by the hirer. Use in competitions or extreme conditions is strictly prohibited.

In case of accidents, loss, theft, or misuse, the hirer will be charged for repair costs or, in case of total damage, for the full replacement value of the equipment.

10. Damage or Loss Policy

  • At the shop: If the equipment is damaged upon return, the cost of repair will be charged according to the current price list.
  • Outside incidents: In case of serious damage or loss while in use, contact us immediately. You may be asked to return the equipment via taxi or another secure means. Costs related to transportation or recovery of the equipment are the hirer’s responsibility.
  • Repair kits (if applicable): Only one may be provided per rental and must be returned complete and in good condition. Missing or damaged kits will be charged accordingly.

 

11. Security Deposit

The lessor requires a credit card imprint, identity document, or credit card as a deposit to cover loss, theft, or damage.

12. Applicable Law

This contract is governed by Portuguese law. In case of dispute, a mediator may be appointed by the parties or judge to attempt an amicable solution. If mediation fails, the court with jurisdiction will be that of the hirer’s residence. In the case of multiple parties, a common court may be designated by mutual agreement or by court order.
